New California Case Protects the Right to a Full Domestic Violence Restraining Order Hearing
When someone seeks a Domestic Violence Restraining Order (DVRO), they are often asking the court to make decisions that will profoundly affect their safety, family, and future. The Case
In In re Marriage of G.E. & I.D., the petitioner sought a domestic violence restraining order alleging years of abuse and coercive control. The trial court issued a temporary restraining order and began hearing testimony.
As the hearing continued over multiple court dates, the judge ultimately dismissed the petition before all of the evidence had been presented, citing concerns about the amount of court time the matter had consumed.
The California Court of Appeal reversed.

The Court of Appeal made clear that trial courts cannot dismiss a pending DVRO petition simply because it has taken too long or because of calendar congestion.
Instead, courts must decide these cases on their merits after giving the parties a meaningful opportunity to present their evidence.
The decision emphasizes that the Domestic Violence Prevention Act exists to protect litigants and that administrative convenience cannot override those statutory protections.
